On March 20, 1997, a warrant for the arrest of David S. Gingras was issued in Maricopa County for the crime of Sexual Conduct with a Minor, a Class 6 Felony. The alleged crime, which occurred multiple times between 1995-1996, began June 2, 1995. David allegedly fled to California soon after the warrant was issued. Two years later, on June 29, 1999, David Gingras was arrested in San Francisco, California, was declared a fugitive and set to be extradited to Maricopa County, Arizona. That same day, he self surrendered. On July 28, 1999, David Gingras waived his rights to a preliminary hearing on the charges.

A publicly available 36 page police report includes reports conducted by the Chandler and Mesa Police Departments, interviewing the minor victim. She gives disturbing, explicit details about her alleged sexual encounters with David Gingras between June 1995- January 1996, all occurring while she was 16/17 years old, and he 22/23 years old.

The minor victim, who remains anonymous, participated in a polygraph test on March 20, 1996, one full year before David’s arrest warrant was issued. At the time of the alleged sexual conduct, the victim was 16/17 years of age, with David Gingras at 22/23 years old. The report states:

During the pre-test interview, (redacted) related that she had sexual intercourse with David Gingras one time in June 1995 and then one or two times in January 1996 and at least three times in February and at least one time in March 1996. She related that the sexual activity included vaginal intercourse, occasionally oral sex and twice anal sex. On only one occasion did David have oral sex with her; the rest of the time she had oral sex with him.

She further related that David has denied any sexual activity with her at all. She denied having engaged in any sexual activities with any other male. All of these sexual activities she had with David were at his home, except for the first one in June 1995. That first incident occurred at her home.”

The victim was asked the following series of questions:

    1. Did David Gingras actually engage in sexual intercourse and oral sex with you in June 1995? Ans: Yes.
    2. Did David Gingras actually engage in sexual activity with you on several occasions this year? Ans: Yes.
    3. Have you deliberately lied about any of the sexual activities you state you have had with David Gingras? Ans: No.

Analysis of the polygraph test returned “a posterior probability of .996, indicating that there is a 99.6% confidence level in the charts produced by (redacted) as being truthful charts.” and “Based on these analyses and with the information available at the time of the examination, it is the opinion of the examiner that (redacted) is being truthful when she answered the above listed relevant questions as noted.

Due to unforeseen circumstances regarding the prosecutor, a “Not Guilty Arraignment” was held on Thursday, August 5, 1999.

To this day, David Gingras denies any and all sexual involvement with the minor female. David Gingras never served jail time for this alleged crime.
